TSC Extends Maternity Leave Extended To 120 Days
According to the Teachers Service Commission (TSC) has extended the maternity leave period to 120 days in line with the new 2021-2025 CBA.
The latest announcement is contained in the recently-signed 2021-2025 Collective Bargaining Agreement (CBA). On the other hand, male teachers are entitled to three weeks of paternity leave.
In a Circular dated the 10th of February 2022, the TSC Chief Executive Officer (CEO) Dr. Nancy Macharia stated that the allowance of paternity and maternity leave as stipulated in the Code of Regulations for Teachers (2015) and the CBA 2021-2025 provide for both maternity, paternity and pre-adoptive leave starting from July 1, 2021.
The TSC CEO implored teachers to apply for paternity leave, maternity or pre-adoptive leave via the Human Resource Management Information System early enough to allow for re-allocation of lessons and vacancies in their respective schools.
Petition over Extension of Paternity Leave
A petition has already been lodged in court in a bid to see the paternity leave extended for all Kenyans to three months (90 days).
Magare Gikenyi, a medical practitioner from Nakuru filed the petition and is seeking to see men given three months paternity leave. He argues that men and women have equal responsibility for the infant or the adopted child.
According to Magare, scientific studies indicate that men bear the same weight in terms of responsibilities just like mothers during the first three months of the child being born.
“Rolle et Al’s systematic review done titled Father Involvement and Cognitive Development in Early and Middle Childhood, states clearly that a father has the same role in childhood development and that the first few days of life are crucial for the development of the child,” noted Gikenyi.
According to Gikenyi, the Employment Act of 2007 gives men a raw deal since women enjoy more days on leave than men.
