Students Facing Murder Charges want Court’s permission for a Plea Bargain

Two secondary school students who were arrested for being suspected of the death of a man seven months ago are seeking permission from the court to allow them to seek reconciliation with the deceased’s family via a plea bargain.

A plea bargain is a negotiated agreement between an accused criminal and a prosecutor whereby the accused agree to voluntary plead “guilty” or “no contest” for a concession from a prosecutor in exchange for a plea.

Eldoret High Court Judge Reuben Nyakundi told Oliver Kipruto (in Form Four) and Brian Kipruto (in Form two) that the family of the deceased was willing to accept a plea bargain agreement with them.

In the murder case, the accused are represented by Lawyer Nathan Oburu.

On the 6th of January 2022, the duo were arrested by officials from the Directorate of Criminal Investigations (DCI) for allegedly being involved in the murder of Dennis Kiplimo.

The deceased had been caught stealing from the first accused’s house and along with other suspects clobbered to death the deceased in Osonga village in Turbo sub-county, in Uasin Gishu County.

According to the charge sheet, the deceased was subjected to mob justice before he was rushed to a nearby hospital where he succumbed to his injuries.

The first accused was released on a Kshs. 400,000 bond while his co-accused is remanded at Eldoret GK prison because he could not raise the bond imposed by the court.
