Teachers’ Lawyer Soyinka Lempaa has sued the Teachers Service Commission TSC for employing 10,300 qualified teachers as interns.
Mr. Lempaa, formally a teacher by profession before becoming a lawyer, claims the Ksh. 15,000 for Secondary School teachers and Ksh. 10,000 for primary, is too low in comparison to the other employed teachers.
Interested Parties Can Join the Petition
“Interested parties can join petition 17 of 2020 filed at the Employment and Labour Relations Court,” says Mr. Lempaa.
The labour court has certified Lempaa’s case against TSC as urgent.
TSC Case Hearing Date Set to 24th
The employment and labour relations court judge Justice Helen Wasilwa has scheduled the case hearing on the 24th of February 2020.
Lawyer Wrote to TSC in 2019 for Teacher Intenship Contract Details
In the petition, the lawyer wants the teachers’ commission to explain why it wants to employ qualified teachers as interns.
“When we wrote to them on December 2nd, 2019 asking for the details of the contract, they declined to furnish us with the information“, said Mr. Lempaa.
The lawyer based his request according to Article 35 of the Constitution of Kenya, 2010 and Section 8 and 9 of the Access to Information Act.
In the letter referenced, ‘Request for Information Regarding Contracts for Employment of Primary and High School TEACHERS’, the lawyer wanted the commission to explain how it decided to pay Kshs. 10,000 and Kshs.15000 for Primary and Secondary School Interns respectively.
He also demands to know whether TSC consulted with the Salaries and Remuneration Commission before sticking with the low pay figures for the teaching interns.
In the December 2019 letter, the lawyer asked, “why teachers who are as qualified as permanently employed teachers are subjected to such low salaries”.
Lempaa Won Last Case against TSC in 2019 on Employment Age Limit
Mr. Soyinka Lempaa’s petition 17 of 2020 will be the second case he’s taking against TSC.
In November 2019, Mr. Lempaa won a case and obtained orders for TSC to lift the recruitment age limit from 45.
The court agreed with Mr. Lempaa that the TSC’s 45 years age barrier for recruitment as discriminatory, unreasonable and unconstitutional.
Mr. Soyinka Lempaa, a former English and literature teacher cum Journalist, is currently a practicing lawyer with Mugeria, Lempaa & Kariuki Advocates.
Who is this Teachers’ Lawyer, Mr. Soyinka Lempaa?
Mr. Soyinka Lempaa is an alumnus of Gatero Secondary where he completed his high school education.
He later joined the University of Nairobi to pursue a Teaching Course in English and Literature.
However, Mr. Lempaa crossed over from Education to Journalism after hos Post Graduate Diploma in Mass Communication Class of 2001 from the same University of Nairobi.
Later, he enrolled at the University of Essex to study International Human Rights Law.
Lempaa has worked as a Journalist with Kenya Broadcasting Cooperation KBC.
He’s currently a practicing lawyer with Mugeria, Lempaa & Kariuki Advocates.
