TSC Warns Teachers Pressure Group It Has the Mandate to Transfer Teachers
The Teachers Service Commission (TSC) has warned the Kenya National Teachers Pressure Group that it has the right to transfer teachers from one school to another.
This comes after the group’s case was dismissed in court after five teachers belonging to the group protested their transfers to their new schools.
The teachers had gone to court demanding the Employment and Labour Relations Court to stop TSC and its agents from effecting their transfers pending the determination of their protests.
However, the Labour Relations court judge Nelson Aboudha in a ruling said that the claimant is not competent to start any action before it and any other court or tribunal. The ruling reads as follows:
“As things stand now, the court is uncertain whether the claimant is a trade union, a society, welfare group, political party or any of the creatures permitted under the regulatory framework governing collective organizations,” ruled Abuodha.
The court cannot, therefore, hand the bugle of its sacred order on an invisible baldric” Ruled the judge.
The group now has to simply relax go about their duties as teachers for the foreseeable future while adhering to the regulations and guidelines issued by their employer, TSC.
