The Employment and Labour Relations Court (ELRC) has reinstated Dr Kennedy Mulunda as the Teachers Service Commission (TSC) Deputy Chief Executive Officer (CEO).
Hon Lady Justice Monica Wanjiru Mbaru of the ELRC ruled that Dr Mulunda should resume duty starting the 1st of December 2022 at 8:00 am for deployment.
“The petitioner is hereby reinstated back to his position as Deputy Commission Secretary with the 2nd respondent without loss of salary, benefits or work entitlements. The petitioner shall report on duty from December 1 2022, at 8:00 am for deployment,” ruled Lady Justice Mbaru.
The ruling was issued on the 30th of November 2022.
Dr Mulunda had been dismissed from duty by TSC through a letter dated the 20th of June 2022. The letter had been signed by the TSC Secretary and CEO Dr Nancy Macharia who is tasked with power over the secretariat staff.
Mulunda was alleged to have solicited tenders from principals, corruption and abuse of office by commissioners who had investigated him over the issue through a disciplinary committee in the beginning of the year.
In the termination letter, Dr Macharia said that she had acted in following with the directives from the commissioners after a probe had been carried out by principals who had found overwhelming evidence against the now-reinstated TSC Deputy CEO.
“Pursuant to the provisions of clause 10 of your employment contracts, the commission has made a decision to terminate your employment contract with effect from June 20, 2022,” read part of the dismissal letter issued by the TSC CEO Dr Nancy Macharia to Dr Mulunda.
